Researching On Crime Problem Of Credit Card In China

Since the reform and opening up, credit card gains rapid popularizationwith the development of social economy in China due to its convenience, quickand safety. But the crime problem of credit card causes more and more socialattention. Firstly, the thesis defines the conception of credit card and analyzesthe current situation of crime of credit card in China. Secondly, the thesisexpounds legal risk of crime of credit card based on such two aspects asbanks and enforcement of crime of credit card, analyzes the origins of crime ofcredit card in China. Then, the thesis expounds the present situation ofregulation and institution of crime of credit card used in Criminal law in Chinathrough the comparing and researching of internal and external legislativesituation of credit card. Finally, the thesis raises suggestion for perfecting thedevelopment of legislative institution and legislation. Besides, the thesisintroduces risk management theory into publishing management system inorder to establish legal orderly, risk-moderate and profits-losses-exacttransaction order of normal credit card. The legislation suggests that legislationshould normalize the dispensing of bank’s credit card, its managementbehavior, the differentiating of basic concepts of credit card, conviction andpunishment of relative crime of credit card enforced by units, strengthening ofinformation safety of cardholder, advancing of judicial intervention of crime ofcredit card, establishing and perfecting of individual credit system.
