At present, the issue of climate change is becoming the focus of attention of theConvention on Biological Diversity. Closely related to climate change and biologicaldiversity, many endangered species in the backdrop of the global climate change, speciesrange to reduce the fragmentation and loss of the original distribution, abundancedecreased population decrease in the number of biodiversity have been seriously damage.Under this situation, more and more experts believe that: climate change mitigation andthe protection of biodiversity as a whole to undertake relevant studies. To enhancepenetration of the United Nations Framework Convention on Climate and Convention onBiological Diversity, on this basis to take appropriate measures and related legislation inorder to better mitigate and address the impact of climate change on biodiversity. Thispaper first discusses the impact of global climate change on biodiversity, specific analysisof animal, plant phenology change, population change; discusses the status of internationaland foreign legislation, including in international legislation focuses on the biologicalimportant principle and the legal system of the CBD and the United Nations frameworkConvention on Climate, and other important international treaties, and then summarizedon the basis of analysis on the European Union, the United States and other developedcountries, legislative status, China needs to learn from the legal system; discusses thecurrent situation of the domestic legislation, on the domestic legal system to analyze andsort out its strengths and weaknesses, on this basis to explore how to build a domesticlegislative system.
