The Judicial Protection Of Network Copyright In China(2002-2011)

Network copyright is the owner’s right for his or her works protectedby copyright law on the internet, and it is a part of intellectual property law.As the development of economy and internet in our country, networkcopyright infringements occur frequently. So how to effectively protectnetwork copyright is great necessity for intellectual property protection.The court exercise judicial power by judging network copyright caseslegally, helping halt network tort and protect the legal rights of copyrightowners, which put network copyright into judicial protection.By using statistical analysis software SPSS18.0, the thesis collects allthe judicial adjudicative documents in network copyright from2001to2011, and then encodes them after text analysis, based on which it analyseand evaluate the present situation of network copyright in our country withstatistics method. The thesis has three points of view: First, it has acomprehensive study on the nationwide present situation of networkcopyright judicial protection. And then, according to the economicdevelopment level, choose Shanghai, Chongqing, Guizhou asrepresentative samples to make area differential analysis. At last, it has aspecial research on network copyright cases in which the plaintiffs areforeign artificial persons or natural persons.
