Legal Suggestions On Chinese Flawed Marriage

In2001, the flawed marriage has been clarified in the Marriage Act for the first time. This is a mark progress in the history of the marriage legislation. Our Marriage law stipulates the legal causes the legal procedures and the legal consequences of flawed marriage is so simple that there will be no legal basis for it when the special cases happen. In that case our judges have to judge the cases by the discretion I think this is very unfavorable for preserving our marriage and family. Therefore our flawed marriage should be further developed. In order to provide theoretical supports for the flawed marriage this article is divided into four parts. The first part of this article i mainly describe the concept of flawed marriage the legal basis of flawed marriage and the history of flawed marriage. The second part of the article i mainly discuss the current legislation of flawed marriage and the shortage of flawed marriage. The third part of this article i introduce the oversea legislation of flawed marriage and analyze some shortcomings in our flawed marriage through summing up the same point of the oversea flawed marriage. The last part of this article puts some measures for perfecting our flawed marriage on the base of shortcomings of it.
