Natural person bankruptcy law in China’s Hong Kong and Taiwan and many othercountries has developed to a relatively mature situation, and it has been also mentionedonce in the legislation of our country. But due to various reasons, it has not beenpublished yet, still in the so-called" half bankruptcy law” situation. Which leads to whenthe natural person in our country faced substantial "bankruptcy”, there’s no remedy canbe found. This paper based on the natural disaster and social risk caused on theestablishment of natural person bankruptcy law’s discussion as the breakthrough point,emphasize analyzed the necessity and feasibility of our country to establish the s ystemof natural person bankruptcy. We borrow legislative experience from foreign base onChina reality and do many conception of the rule to establish the natural personbankruptcy law.This article consists of four chapters: The first chapter: Made an overview ofBankruptcy Law. Mainly from the bankruptcy system of natural person’s meaning,natural person bankruptcy law features and natural person bankruptcy system historyand legislation comparison research on three aspects. The second chapter: From theangle of practical experience and theoretical basis,demonstrates the necessity andfeasibility of the establishment of natural persons bankruptcy legal system in our China.The third chapter: It is the key chapter, separately from the legislative mode,construction of procedures, entities in the system design three levels for establishing thenatural person bankruptcy law conception. The fourth chapter: The natural person goesbankrupt system sound, including the establishment of natural person credit sys tem,perfect the mechanism of natural property management system and improve the socialsecurity system.
