On The Legal Protection For The Sports Television Broadcasting Rights

As part of the human social life, Sports embodies a kind of culture, and represents thetrue spirit of perseverance for human kind. In the new era of21stcentury, sports is nolonger just a game to play; driving by the force of Market-oriented Economy, the entiresports industry shows itself industrialized, market-oriented and information-preferred;thanks to the improvement of sport game’s competitive and attractive nature, sport gameTV broadcasting had become one of the most effective and profitable ways to present thegame to the audience, and played an important role in promoting the development of thesports industry. In that context, this paper tried to discuss some legal issues arising fromthe sport game TV broadcasting.This paper can be divided into four parts. In the first section, two cases had beenpresented and analyzed for the purpose of introducing the thesis theme; the rest of thesection aims at analyzing the necessity of the paper theme. Secondly, this paper is trying toanalyze the legal nature of sport game TV broadcasting and come to a conclusion afteranalyzing international legal protection/regulation cases for the aforesaid genre. Thirdly,this paper aims at making an analysis about the protecting/regulating status quo for sportgame TV broadcasting in China, and presenting countermeasures for the same thesis.This is an era of knowledgebase economy, like sport game TV broadcasting rights,the virtual rights are important assets for every unit inside the industry which providegreat impetus for the industry’s development. There weren’t much legal study on the sportgame TV broadcasting rights, even there were, these researches are not extensive. Thispaper attempts to make such study in terms of legal protection/regulation for the sportgame TV broadcasting rights.
