Study On International Legal System Of Nuclear Safety

Nowadays, the shortage of energy became a problem of people. Nuclear energy, as the substitute of traditional energy, occupies an important position of energy structure. Compare with the traditional energy, nuclear energy has its special feature. It’s clean, effective and economic. In the process of making use of nuclear energy, the way we keep the nuclear energy safety should be considered.The paper is divided into five parts.The first part introduces the concept of nuclear safety, and it explains the detail concept of nuclear safety in this paper. In addition, the first part also introduces the condition of nuclear energy uses in many countries, and it tells three serious nuclear accidents in the history.The second part accounts for the extant international legal system of nuclear safety. The main international legal system includes the international legal system of radioactive materials management, such as Convention on Nuclear Safety and Joint Convention on the safety of Spent Fuel Management and on the Safety of Radioactive Waste Management, the international legal system of nuclear accident, such as Convention on Early Notification of a Nuclear Accident and Convention on Assistance in the Case of a Nuclear Accident or Radiological Emergency. Besides these, IAEA itself and its safety standards are important parts of international legal system of nuclear safety.The third part analyzes the defects of international legal system of nuclear safety. It analyzes the international legal system, the detail regulations, the weak enforceability of laws, and the weak supervision and the defects of IAEA.The fourth part gives the solutions of improving international legal system of nuclear safety. We can improve the international legal system, enhance the function of IAEA, improve the cooperation of countries, and transfers conventions into the domestic law.The last part discusses Chinese legal issue of nuclear safety. It points out that the defects should be improved, and it gives the detail information of solving the problems. It’s important for China to improve, to develop Chinese nuclear energy. It also helps a lot for us to form a safe nuclear environment.
