Analysis Of Human Rights Protection Issues Of Chinese Criminal Defense System

Criminal accountability is a state activity for crimes investigating, it has two purposes going hand in hand, one is punishment crimes, and another is protecting human rights.Since ancient times, criminal punishment was one purpose, and with the development of modern criminal law and the modern concept, the protection of human rights was gradually established.Because of the factors such as lawsuit idea, deviations in legislative and judicial practice, Chinese criminal defense system has many weaknesses which prevented the existence of the process of judicial reform, affecting the image of the judiciary impartial administration of justice, while not conducive to security suspects, accused of human rights, therefore, improving the criminal defense system potential is inevitable.On the base of introducing basic theory of human rights protecting, his paper focuses on the analysis of the issues and causes in violations of human rights in the criminal defense system, compared the similarities and differences between U.S.criminal system and Chinese criminal defense system, made reference views, and finally made up the actual proposal for strengthening human rights protection of Chinese criminal defense system.
