Research On The Problems Of Judicial Credibility

Judicial credibility is the essence of judiciary, it reflects the psychological state of trust and respect of people, and the level of identification and faith that people toward to judiciary. However, in recent years, judicial credibility in the low level, and it brings a lot problems, especially in the case of appealing and the case relates to petition letter is keep up growing, and the problems of difficulty in execution, and problems of people tend to settle disputes in private, and the problems of people always seeking the other way to help them expect judicial, and so on, and it shows the dissatisfaction and distrust of people on judicial. So, it is urgent to solve the problems in judicial activities, and enhance the judicial authority.This article from the interpretations of concept of judicial credibility and the shortages of present situation, using empirical analysis methods, from five point to analysis and research, which is social perspective, the judicial system, courts and judges own reason and quality, the interested parties, and some contrastive dates from the basic courts. And then put forward the corresponding countermeasures and the suggestions, looking for a way to promoting judicial credibility in China.Except Introduction and Conclusion, the whole paper is divided into three chapters, the introduction expounded the source, purpose, significance, and generalizing the present situation of the judicial credibility in China, made a theoretical groundwork for the research of judicial credibility. Chapter one generalizes the concepts and origin of judicial credibility, and generalized the present situation of judicial credibility. Chapter two is from social perspective, the judicial system, courts and judges own reason and quality and the interested parties, to analysis the problem of judicial credibility, and using empirical analysis made a deep research on the courts and judges, the two main bodies of influencing on judicial credibility. Chapter three is using improve the judicial credibility as a topic, from six different parts gives corresponding countermeasures and the suggestions. The last is epilogue, the conclusion of the paper.
