| After accsessing in WTO for ten years, China has been the largest Vehicle market in the world. By the end of2011, the quantity of possessed vehicles in China has been over2.35billion, while the quantity of possessed automobiles has been over1.05billion. The quick development in automobile industry improves the traffic infrastructure construction, however, it also brings a lot of problems in the road traffic safty, especially several malignant crime cases happened in recent years. As the conviction and sentence rules of traffic crime in Criminal Law became unreasonalbe, more and more people ask for legistation perfectcion. After "Sun Weiming case", a drunken driving case which lead to4death and1injury, was sentenced to death, a nationwide management of drunk driving begun. Drunk driving was concluded in Criminal Law, and excuted prison sentence in1st May2011, however, there are still several people killed by drunk driving in this condition. All the facts prove that, traffic crime, not only breaks the road traffic order, but also obstructs the economic development indirectly, has become the most important factor influencing traffic safety.Statistic from traffic police shows that, in2011, there were210,812road traffic accidents happened and lead to237,412death, in average,1person was killed in an accident. What’s more,95.8%accidents were caused by illegal driving. When "automobile time" arrives, we should make research on how to prevent traffic crime, otherwise, people’s life and fortune will be in danger.In this paper, the author studies the traffic crime cases which happened in the past five years in Jiangxi Province, describes the traffic crime situation and the harm to society, and generalize some characters of the traffic crime. Based on the Chinese Laws, the author tries to use the criminology to analyse the reasons of traffic crime, and find sicentific ways to prevent it, with the aim of minimizing the traffic accidents and protecting people’s life. |
