Study Of Road Traffic Safety Laws And Legal System

Since the law of road traffic safety possesses combined technology and social two-way features, a study is therefore carried out to investigate both the road traffic safety in terms of macro and micro ways and the principle of road traffic safety law, based on the theory of traffic engineering, law, engineer and social science, and methodologies of system analysis, comparison, evidence confirmation, data statistics, trend prediction and traffic safety mechanism analysis. With the obtained knowledge and law theories, a new road traffic safety law system for the new century is developed through the comparison of road traffic safety law systems between China and abroad, and the thorough analysis of the efficacy and future re-construction of the current safety law system.Based on the previous studies, this paper developed a road traffic safety affecting macro-factors set and its interactive model for the road traffic and society environment system in addition to a 4-dimenssional road traffic safety feature description model, through systematic analysis and the analysis of interactive rules. With the support of complete and useful information, a road traffic safety prediction model is established with specified periodic trigger value by using regression technique. The result of those studies can provide directional and strategic basis for the development of road traffic safety in China. Based on the analysis of systematic factors of road traffic safety, a discussion of the key role of law system and its way of impact on road traffic safety is made, which would provide technique support for the construction of road traffic safety law system and scientific adjustment of road traffic safety relationship.According to the traffic features of users, vehicles, roads and environments, this paper also carried out a deep and systematic study on the mechanism of road traffic accidents in the micro way. The emphasis of the study is to clarify the inherent features of traffic behavior and key causes of traffic accidents. The result shows that interactions among road, vehicle and environment exist behind the 'blame of user' in the traffic accidents. Through the study, the key points and basic direction of road traffic safety law system construction are judged, and some principles are developed as well.In order to construct the theoretic framework of road traffic safety law system in China, a deep and systematic study is carried out to reveal the connotation and basic features of road traffic safety laws, the relationship of road traffic safety laws, the general system and its law source of road traffic safety laws, based on the analysis of inherent rules of jurisprudence, road traffic laws and road traffic safety management. The discussion of main body and principles of legislation as well as some basic problems of law implementations are also conducted. Those studies primarily constructed a theoretic framework of road traffic safety laws and provided anacademic law bases for the construction of road traffic safety law system.Based on above theories and methods, a thorough comparison of road traffic safety law systems between China and abroad is made. By adopting the experiences of some of the developed countries and analyzing the deep-seated problems existing in current framework of the road traffic safety law system, the key-points, basic direction and principles of the construction of road traffic safety law system are clarified in this paper.The author finally developed a road traffic safety law system for China in the new century, based on the discussion of the core contents of system framework, hierarchy, main body law, ramose law, which aim at providing theoretic and methodological support for the construction and implementation practice of road traffic safety law system in China.At the last section of this paper, a summary result is provided followed by a future study.
