Criminal indictment system is established to ensure the criminal law is effectively implemented and the penalty in the criminal law is a compulsory measure by limiting or depriving some rights of the criminals who will suffer certain loss and pain, which is the essence of penalty. Criminal penalty refers to some significant rights such as life, liberty, property and qualification. From a whole point criminal penalty is the most serious compulsory measure the country takes to the criminals. Criminal indictment is an action of inquiry and investigation of the crimes. It refers to the citizen’s two basic rights:life and liberty which are the foundation of other rights. Thus it is very natural that how to ensure the national judicial power is correctly enforced and prevent from abusage which could lead to violate the citizen’s personal rights becomes the focus of people.This paper elaborates the protection of human rights in the criminal indictment based on the revision. Apart from introduction and conclusion, this article includes four parts:first part is about the basic connotation of human rights protection in criminal indictment; second and third part analyze the deficiencies of criminal indictment law of1996edition in the human rights protection and the progress of revision, the final part explains the defects of the revised criminal indictment and the developing trend of the human rights in the criminal indictment of future.
