Study On The Perfection Of Dual Inheritance Legal Protection In China

Dual inheritance is the world heritage that merges natural heritage together with cultural heritage. As a crystallization of natural masterpiece and human wisdom, dual inheritance is the common wealth of all human beings of high natural and humane value in researching into history, maintaining biodiversity and promoting the sustainable development of global society, economy and environment. In recent years, commercial development has twisted the objective of administrating and protecting dual inheritance. Additionally, economic development demands and deficiency in human financial and material resources have also brought more difficulties for the protection of inheritances. However, with regard to its scarcity and impossibility to remanufacture as well as the high pressure faced, it is of great urgency to protect the dual inheritances. At present, China is confronted with an embarrassing dilemma. Analysis indicates that the fundamental reason for the ineffective dual inheritance protection in China is the deficiency of legal system of world heritage protection. Perfecting the protection system is the only way to the reinforcement of dual inheritance protection and the maintenance of sustainable development in natural and cultural resources. On the subject of the perfection of dual inheritance legal protection, the thesis is divided into five parts for further analysis and exposition.Chapter one mainly defines the basic concept of dual inheritance and concludes its characteristics as valuable natural and cultural resources. Fundamental issue specified, this part lays the basis for following discussions.Chapter two illustrates the international protection of dual inheritance. Starting with an overview which includes the distribution of world dual inheritances, crisis confronted and the significance of the protection, this chapter summarizes the international conventions and institutions on the protection of dual inheritance. Lastly, the existing deficiencies in the present protection system of dual inheritance are pointed out. Chapter three bases itself on International conditions, analyzing related legal systems of certain authoritative countries on world heritage protection and looking for the commonplace of their successes. It is expected that their successful experience can contribute to the perfection of the domestic legal protection of dual inheritance.Chapter four turns back to China, outlining the dual inheritance at home and its legal protection situation. Then Mount Wuyi is taken as an example to systematically introduce its inherent natural and cultural heritage. By analyzing the present contents of legal protection, this part researches into the conflicts in the legal protection of Mount Wuyi which extends to the analyzing of the deficiency of the legal protection of dual inheritance in ChinaChapter five summarizes the whole thesis. Based on sufficient analysis throughout the four chapters above, this chapter presents with suggestions on how to perfect the legal protection of dual inheritance in China. In the first place, a special law for world heritage should be established. Moreover, as to many other problems in the domestic protection of dual inheritance, a series of systems in coordination with the special law will be proposed, which is combined with international successful experience, with the expectation of establishing a perfect legal protection system of dual inheritance.
