The Research On Our Country Electronic Bills Legal System

Electronic bills can be divided into general and narrow sense which are general electronicbills and narrow electronic bills respectively. Compared with Traditional paper-based bills,electronic bills have speed advantage, cost advantage, as well as advantages of risk preventionand control. As a specialized standard bills legal system,"The Law of Bill" is lack ofstandards of electronic bills, as well as existing electronic bills aspects of legal documents.These reasons make eager to perfect the legal system of China’s electronic bills system. Theelectronic bills in the current legal norms to regulate the legal documents "electronic signaturelaw, e-business bill business, the National Check Image Exchange System business approach".The extensive use of electronic bills promotes the development of related legislation, manycountries have introduced regulation of electronic bills of laws, regulations and other normativelegal documents. As developed by the United Nations Model Law on Electronic Commercepromulgated the "Electronic Signatures Act", and the U.S. world point notes Legislation andSingapore legislation provides good examples. In reference to the relevant foreign legislationand on the basis of the legal system, the Conceptions of Chinese electronic bills legal systemare proposed in this study.For the mode selection in the amount of bills legislation,it should beflexible legislation instead of single-type and centralization.For perfecting Legal System ofChinese electronic bills, firstly we should determine the scope of application of electronicbills,then clear electronic bills intersubjective rights and obligations of these entities, includingcustomers, banks, electronic authentication, electronic clearing center,the last we must establishthe liability system which contains civil liability, administrative liability,and criminal liabilitywhich including electronic bills liability system.
