On The Credit Card Crime And Its Prevention Countermeasures

Community correction is the manifestation of socialized, humane and efficient modernpunishment system. It is the counter punishment of prison correction, which reflects thebasic trend of international punishment turns from a strict one to a more tolerant one.Originated from western countries in1970s,community correction prevailed around theworld quickly and was employed widely and achieved a favorable result. China startedcommunity correction for local trial officially since2003and formally confirmed the statusof community correction in China’s criminal law in2011, which drew the curtain of the newstage of the development of China’s community correction. Over the last decade’sdevelopment, China’s community correction has made great achievements and formeddistinctive community correction models, among which “Beijing Model”,“Shanghai Model”and “Guangzhou Model” are typical representatives. However, problems existing in China’scommunity correction have exposed thoroughly in the experiments in selected places, whichhas impeded the smooth development of China’s community correction.Based on existing researches in China and abroad, combining with relative theories andthrough statistic analysis, descriptive analysis, comparison between individual cases, thisessay analyzes and compares the concrete domestic and international status quo in detail,put forward the existing problems of China’s community correction at this stage and explodethe root causes to put up with corresponding feasible countermeasures and suggestions. Thespecific arrangement of this essay is as follows:The first chapter is introduction. Through explaining the background and meaning of thisresearch in a simple way, the research area is confirmed; and then after the generallyanalyzing, summarizing and commenting relative research of community correction in Chinaand abroad, further illustrates the research problem and meaning of this essay.The second chapter is overview and rationale of community correction. Firstly, thischapter illustrates the relative conceptions and definitions, historical evolution and featuresof community correction in detail and then describes the rationale of community correctionspecifically, which includes ideology of the criminal code humility, deepening resettingtheory， function of correcting theory, efficiency of punishment theory, label theory,socialized punishment theory. The third chapter analyzes the status quo of community correction, mainly focusing onthe comparative analysis of national and international status quo of community correction.International cases include the status quo and features of community correction in Britain,America and Japan and national cases in Beijing, Shanghai and Guangzhou.The forth chapter analyzes the existing problems of community correction in China,mainly illustrating legal issues of our community correction from three aspects and problemsin practicing from six aspects respectively.The fifth chapter is the countermeasures and suggestions for the community correction,mainly focusing on six aspects including completing legislation, clearly defining executingbody, enriching the content and management method, perfecting professional correctionteams, enhancing publicity of public opinion and formulating practical financial insurancemeasures.
