Research On The Perfection Of Community Correction System In China

After the pilot project in 2003,the community correction work in China has been expanded in 2005,comprehensively implemented in 2009,and comprehensively promoted throughout the country by 2014.It has been continuously promoted in the interweaving of practice exploration,system construction,reform design and legislative argumentation.However,with the further development of community correction work,the existing problems of community correction system are gradually revealed,such as the lack of a systematic community correction model,the neglect of the links between relevant legal norms in legislation,the imperfect construction of education correction system,and so on.In view of the above problems,based on the current situation of community correction system practice in China,this paper rethinks and puts forward corresponding suggestions for improvement.The full text consists of four chapters.The first chapter is an overview of the correction system.This paper focuses on the understanding and definition of the concept and nature of community correction,and holds that the concept of community correction should be defined from the point of view of the purpose of the system.The definition of community correction should be: "Community correction refers to those criminals whose nature of crime is relatively minor and whose social harm is relatively small,who are placed in the community,and the specialized state organs are in the relevant societies." With the assistance of associations,non-governmental organizations and volunteers,within the time limit set by judgments,rulings or decisions,they should correct their criminal psychology and bad habits,and promote their smooth return to society in the execution of penalties.At the same time,through the demonstration of the object,link and purpose of the correction,it is concluded that the community correction should be defined as "penalty execution activities".The second chapter aims to construct the community correction model.With the further development of community correction work,many different modes of content or form have been formed throughout the country.In order to facilitate the unified implementation of the community correction system nationwide,a set of unified community correction modes should be constructed for the whole country.The community correction model constructed in this paper consists of the following two modules,namely "confession and repentance" module and "hierarchical management" module.The goal of confession and repentance is to encourage prisoners to confess and repent,accept fair moral values and return to shame;the purpose of grading management is to classify community prisoners through risk assessment,implement differentiated monitoring and correction methods for different levels,effectively correct prisoners and maintain community safety.Chapter ? and Chapter ? are to sort out the main problems existing in the implementation of community correction system at this stage,and put forward suggestions for improvement.At present,the problems of community correction are mainly reflected in the construction of legal system,correction team and education correction system.Therefore,we should solve these problems from these three aspects.Firstly,for the legal system,we should build a complete legal system of community correction,clarify the nature of community correction in legislation,expand and improve the applicable objects and scope of community correction;secondly,we should strengthen the construction of community correction team,improve the financial security of community correction team,and make it possible by building a systematic and scientific mechanism of talent introduction and effectiveness evaluation.More talents are willing to devote themselves to the community correction work.At the same time,in order to ensure the seriousness of the community correction penalty execution activities,the people's police should be equipped in the ranks of law enforcement workers.Finally,the education correction system should be improved,the education learning mechanism should be improved,the education correction work team should be formed,the network learning courses and vocational skills training should be developed and enriched,and the community should be established.
