Disclosure of environmental information has much significance in promoting the transformation of the mode of economic development and government environmental regulation, maintaining the environmental justice and order and protecting environmental interests of the public.Analyzed from Zijin Mining Pollution Door event in2010, the major factors leading to the unsatisfactory implementation of the disclosure system——Disclosure of Environmental Information (Trial), which is China’ s current main disclosure system of corporate environmental information, are as follows: showing no attention on the dynamic changes; the narrowness of the main obligations; Lacking unified principal standards, the misuse of trade secrets; abnormal light legal responsibility, lacking rights remedy, etc.The corporate disclosure systems in the US, Japan and European countries are characterized by clear subject of a duty, standard disclosure contents, proper and stable disclosure procedures and effective relief ways. All these features are enlightening to the complement of corporate disclosure system of our country.At present, improving our disclosure system of corporate environmental information should take into account the legal and institutional structure. Legal structure, in addition to improving the legal position of the disclosure system of corporate environmental information, should also strengthen convergence with the relevant laws. As for the main obligations, it should expand the range of mandatory disclosure of enterprises, and strengthen the leading role of government. As for the content of disclosure, it should establish systems of releasing pollutants and transferring registers, compatible with China’s national conditions and the level of enterprise development, strengthen the disclosure of dynamic information, especially that of sudden environmental events information and serious exceptions, etc.. As for the procedures, it should perfect the disclosure mechanism of application, relax restrictions on claimants, and discriminate different circumstances to determine the timeliness of the requirements of information disclosure. As for legal liability, it should establish the punitive compensation system, perfect criminal prosecution and increase the cost of illegal enterprises. In this way corporate disclosure of environmental information will better serve the enterprises to save energy and reduce emissions, adjustment of economic structure and promotion of scientific development.
