Study On The Citizen Participation Mechanism Of Urban Housing Demolition

Urban housing expropriation and demolition is a common phenomenon in urbanization and the process of city construction, along with the further development of the city, the scale of urban housing demolition is continually expanding, increasing housing demolition is involved in many households, while the urban housing expropriation and demolition involves the interests of all parties, especially the interest of subject being expropriated, the house expropriator and the expropriated often fails to reach an agreement, resulting in contradictions and disputes. In recent years, the problem of land expropriation and demolition caused widespread concern in society.From the perspective of citizen participation, this paper is on the basis of the participatory democracy theory, deliberative democracy theory stakeholder theory and game theory, focusing on the citizen participation mechanism in urban housing demolition. In this paper, by means of literature analysis and cases analysis, based on the generalization of existent literature and selection the three of the actual cases which happened in different regions, summarized the presence and a series of problems of citizen participation mechanism, such as the main body of citizen participation mechanism participating in a non-institutional way, citizen participation mechanism has a narrow range of influence, the influence depth of citizen participation mechanism is not enough, and then the paper analyzes the factors that affect the mechanisms of citizen participation in urban housing demolition, the author will divided three parts to analyze them:first, analysis on the external environment of urban housing demolition, first of all, on the level of system, it is lack of perfect security mechanism to guarantee the citizen participation, secondly, administrative environment, local government behavior anomie hinders the citizen further participating in the urban demolition, at last, judicial environment, the judicial remedy is unfair, thus citizens’reliving way is blocked, second, analysis on citizen participation program setting of urban housing demolition, it is lack of participative procedures in demolition procedures, specifically on the city planning stage, citizen participation is weakening, on the housing assessment stage, it isn’t transparent and fair, on the demolition compensation stage, it is lack of hearing procedure, at the same time, it is lack of system security for citizen participation, and has no specific operational plan, such as the negotiation mechanism, interest expression mechanism, feedback mechanism, third, the citizens have less rights and status than the housing levy department, so it caused the game is not sufficient;This paper hopes that through specific analysis on the internal issues of citizen participation in urban housing expropriation and demolition, combining with domestic and overseas successful experience, putting forward suggestions from the angle of system, procedure, safeguard mechanism, government behavior, game conditions and judicial relief on the basis of current practice, in order to make citizen participation as a mechanism to implement effectively in the urban housing expropriation and demolition.
