As a form of internet payment, the Internet Third Party Payment has been developed for12years in China. However, after the three phases of birth, exploration and high-speed growth, some problems about the Internet Third Party Payment such as the unclear of the service area of credit guarantee results, the inequality clauses in the contract, washing money and illegal cash covering of credit card began to show up.The laws and reguilations about the legal liability of all the parties of the Internet Third Party Payment is very essential to the problems above. However, there are not such laws and reguilations we can use at present in China. Furthermore, the researchs on the Internet Third Party Payment are mostly about the natue of the subjects, provisions, legal risks and supervisons.This paper applies empirical analysis, normative analysis and data analysis to researching the problems of the legal liability of the Internet Third Party Payment in China. I hope that I can afford some help about the unclear of legal liability of the Internet Third Party Payment in China now through the research on rights and obligations, the laws and regulations, principles and other way. The paper consists of4chapters.Chapter1is about the legal relationship of the Internet Third Party Payment. Chapter2is about the laws on legal liability in other countries. Chapter3is the analysis about the legal liability of the Internet Third Party Payment in China. Chapter4are some suggestion to the legislation of the Internet Third Party Payment.
