Study On The Protection Of Small And Medium Enterprises In China’ Anti-monopoly Law

Small and medium-sized enterprises in its economic prosperity, increase obtainemployment chance plays the important role to make it more and more widespreadattention of each country, due to historical and economic system, China’s small andmedium enterprises long-term in a weak position, with the socialist market economicsystem and the continuous deepening of the global economy further integration, ourcountry also recognize the development of small and medium-sized enterprises inexport, the prosperity of the market, create fair competition in the market theimportant role. This paper expounds the connotation of the small and medium-sizedenterprises, discusses the anti monopoly law and the relationship between theprotection of small and medium enterprises, analysis of anti monopoly law onprotecting small and medium enterprises rationality, cited other countriesanti-monopoly legislation in the protection of small and medium enterprises for thesuccessful experience, explain our country antitrust of protecting small and mediumenterprises the main system, and for me China anti-monopoly law on the protection ofsmall and medium enterprises deficiencies, as well as how to perfect put forward theirown views.This article altogether is divided four parts: the first part elaborated theanti-monopoly law from the perspective of protecting small and medium enterprisesgeneral principles. The first clear our country regarding the definition of small andmedium-sized enterprises standard, description of antitrust law and the relation ofmedium and small businesses, and finally through a series of data of small andmedium enterprises in China’s economic development process plays a huge role,further analysis of anti monopoly law on protecting small and medium enterprises.The second part introduces the United States, Germany and Japan, especially Germananti-monopoly legislation in the protection of small and medium enterprises shall, onthe basis of this, the foreign antitrust law to the small and medium-sized enterpriseprotection evaluation. The third part of this article introduced from two aspects ofChina s anti monopoly law to the small and medium-sized enterprise protection, andon this basis summed up China’s Antimonopoly Law in the protection of small and medium enterprises in terms of the existence of those deficiencies. Finally the articleembarks from the reality, in view of our country antitrust law on protection ofmedium-sized and small enterprises of the shortcomings of the proposed improvementsuggestions.
