The Improvement Of The Theory Of Labor Dispute Arbitration System In China

Labor dispute is related to both the immediate interests of workers and the daily life of their families. If not timely and properly resolved, it is prone to conflict, or even sabotage, strikes, demonstrations and emergencies, which not only affect normal production order, but also seriously endanger social order and stable labor relationship. For its timeliness, efficiency and convenience, labor arbitration has become an indispensable part of labor dispute settlement system in the world. This paper takes the labor arbitration system in our country as the research object, introduces the basic content, then discusses the drawbacks and finally puts forward suggestion to perfect it. The article includes four chapters.Chapter1:Summarization of the labor arbitration system in our country. First, the author defines labor dispute and labor arbitration, and then introduces the legal origin and basic content of labor arbitration system in our country, finally it’s characteristic is discussed on this basis.Chapter2:Drawbacks of the labor arbitration system in our country. The defects are discussed in this part, which are the non-convergence of the labor arbitration and lawsuit, the non-coordination between labor arbitration and labor inspection, and procedural defects such as imperfect challenge system.Chapter3:Reform and improvement of the labor arbitration system in our country. First of all, Through introducing and commenting on models of labor arbitration and lawsuit or labor inspection, the author puts forward the own ideas, second the author provides advice to perfect challenge system and the proof system, furthermore Methods of constructing the property preservation system in labor arbitration are discussed, The final part of this article is how strengthen internal supervision, perfect the judicial supervision and establish business supervision in labor arbitration.
