Research On Protection System Of Overseas Film And Television Works Of China

Now our government is committed to the construction of cultural power, and gives the cultural industry support and preferential policy. The development of copyright is an important part of the cultural development and construction, meanwhile copyright has penetrated people’s daily life, and the information network technology makes copyright and our daily life more closely. Copyright protection is taken seriously increasingly with the deepening of the copyright concept. With the development of economic globalization, copyrights international trade increases gradually, especially trading volume of film and television work as an important medium of cultural exchange and dissemination increases year by year. Overseas film and television works pour into market, on the one hand, to promote the consumption of popular culture and the fair competition of favorable film and television industry; the other hand, the channels of the film works entering our country are not considered "legal", therefore resulting in the chaos of the industry. Contradiction between the diversity channels of foreign film and television works and the basic theory of copyright in particular the principle of copyright automatically, copyright protection theory is somewhat stretched.Sino-US Dispute let us begin to reflect on the film and television works of the protection mode and speed up the process on the protection of foreign film and television works.Civil scholar, Professor Wang Limin proposed dual recognition and protection of theory in the country for the first time. This theory provides a comprehensive theoretical basis for copyright protection of overseas film and television works. Under the current circumstances, the view of Professor Wang Limin not only compensate for the lack of copyright protection of overseas film and television works in China but also correspond with the trend of international copyright protection. In the wave of copyright trade, we should analyse and discuss the type and copyright protection of foreign film and television works to find the theory to guide our copyright legislation and judicial practice to contribute to the development of copyright industries and accelerate the internationalization level of copyright.This article is mainly based on Professor Wang Limin "dual recognition and protection " theory to do the research and build the system of copyright protection of overseas film and television works. Analyse the drawbacks our protection mode and the analysis and interpretation of international conventions and domestic laws, to find the legal basis to build the dual protection theory. At the same time, use comparative analysis method to learn from foreign advanced legal system and combine our actual situation to construct suitable for our country’s institutional system. There are four parts:overseas film and television works and protecting mode;dual protection mode of overseas film and television works; defects of overseas film and television works protection system in dual protection mode; the construction of the dual system of protection of foreign film and television works.
