On Control And Eaducation Of Foreign Criminal Suspect

There are several difficult problems during the judicial in recent years, which are including the high rate of detain of the foreign criminal suspect, the low rate of application release of bail and the low rate of application of Non-imprisonment punishment. For avoidance of the escaping of foreign criminal suspect, many foreign criminal suspects will be arrested, which are inequity on the right of action between the native and alien. For solving the problem above, from2008, the procuratorial organization of Wuxi City established a legal system named control and education System. The foreign criminal suspect will be controlled and educated by the Social Forces in Control and Education Basement. The control and education against the foreign criminal suspect creates favorable conditions and brings about a striking effect for application of release of bail, Non imprisonment punishment and practicable of corrective measures to help. Although the control and education system has been applied for three years in Wuxi City, there are still many problems on this system, which are arisen gradually. The writer thinks that the control and education system shall be stipulated by law spread to the whole country, and the building of the system shall be strict and detailed. So the writer proposes to put forward some advices on the legislation of the Control and Education System on the basis of the demonstration of the Control and Education System and judicial practice.
