Study On The Causes, Preventions And Punishments Of The Judge’s Duty Crime In China

Duty crime, as a stubborn problem of the human society, has constantly received attentions from the international society. Therefore, all countries in the world regard the work to preventing and punishing the duty crime as an important content of the state power construction. With the continuous development of the economic society, the duty crime has presented a trend of high incidence in our country. Among them, the adverse effects due to the judge duty crime should be worse than the general duty crime, which directly leads people to lose faith in law, and lose hope to social justice, resulting in very serious consequence and extremely bad influence. The duty crime has a lot in common with the general duty crime, but based on the judicial nature, the judge duty crime has its own characteristic. Through the analysis of current situation, characteristic and cause of formation of the judge duty crime in our country, this article takes the judge duty crime in our country as the research object, trying to present some advices on how to prevent and punish of the duty crime of judges, only hoping there can be some help with the administering the judge duty crime.
