On The Processing Thefts College Students

College students’ theft has become one of the most common cases incollege and universities, but for the handling of such cases, Sanctionsfrom the college to the application of the law for the handling of suchcases, there are problems of student behavior correction is missing orimproper manner, a significant adverse impact on the community.Starting from this problem, this paper summarizes the status of ourcurrent college students thefts processing raised controversy andproblems which exist, including colleges and universities should bear theliability for behavior modification, college students theft should beincluded in the conditional non-prosecution and community correctionsystem，and combined with Amendment to the Criminal Procedure Law, putforward some suggestions on problem-solving.The author think, though college students thefts have a certain degreeof particularity, the identity of the college students has no essentialdifference with that of workers, peasants, etc, in the legislativeevaluation for criminal law, thus they should not be treated as a specialgroup.First,as to college students thefts, for colleges and universities,they should, under the supervision and guidance of the education sector, take the initiative to bear the responsibility of the students’ educationand behavior modification by establishing a standard mechanism,transforming the arbitrary attitude, strengthening legal education forboth students and instructors, modifying school disciplines and rules,and relevant processing specifications.Second,in terms of improvement of the legal system, because of thelarge controversy in the practices of the trial implementation ofNon-prosecution of Conditions system, the author suggests that it should,on the basis of the fully research and practices, be taken to expand itsscope of application with caution, and gradually applied to the adultcriminal and then it’s applicable legal punishment expanded tosurveillance, detention and three years imprisonment.Third, for Community Correction system, the author propose to set upthe creation of specialized community corrections agencies with theprofessional community corrections staff, use the experience of othercountries for reference, the applicable object should be expanded fromcriminals to Non-prosecution of Conditions system people and other pettycriminals who will apply the extended phase from the execution ofpunishment to the entire criminal proceedings.In this way, the majority of college students thefts will naturallybe divided into the Non-prosecution of Conditions and CommunityCorrection systems, while college students do not need to be treated asa special group, so as to solve the problem of education and behaviormodification for those college students having the conduct of stealing,on the basis of ensuring that the application of the law is just andequitable.
