“Human-powered search”, as an efficient, precise, systematic and comprehensiveway of network searching, is booming nowadays, while at the same time have causedsome violation of right of reputation and privacy, which at last made itself a focus oflegal research.“Human-powered search” is started and dominated by the internet users, which isan effective way to exercise the surveillance by public opinion. On the other hand,“human-powered search” can form a free speech market due to its technologicalfeatures as being timely, convenient, two-way, open exchange, which has greatlyfacilitate the realization of the citizens’ freedom of expression. However, if“human-powered search” is not well guided and regulated, it may possibly harmpeople’s reputation and privacy."Human-powered search" should be guided and regulated by law in order tomaximize its positive effect and minimize the negative part, which requires thebuilding of privacy protection system, personal information protection system and thesupervision to the internet service providers. Our country’s legal protection oninternet privacy is far from perfect, so we have to establish and improve the legalsystem of internet privacy protection; strengthen the industry regulations, encourageself-regulation within the industry; establish a special agency; introduce some privacyprotection software; enhance self-protection awareness among the internet users; startthe international cooperation on online privacy protection; as well as some othermeans to improve the internet privacy protection mechanisms. Meanwhile, ourpersonal information protection legislation is relatively weak, so to build personalinformation protection mechanisms, develop the Personal Information Protection Acthas become imperative. The internet service providers, as the one of the mostimportant practitioner of internet, shall be legally responsible for the harmful resultcaused by "Human-powered search", shall adopt the principle of fault and to be takenas the generally tort. If the internet service providers has performed monitoring,warning and assisting to the investigation when and after the violation of privacy takeplace, then have the exemptions.
