Research On The System Of Mass Tort Law Relief

With the development of industry and progress of science and technology, human beingsenjoy the rich fruits of modern industrialization, at the same time, also in the face of all thenegative effects of process industry and social development to the people. A minority of masstort events such as the frequent occurrence of the damage is no longer limited to a small range,some of which even has caused the social public security. In view of the serious social impactof mass tort accident, the claims of difficulties as well as reality or cannot get compensationissues, this study of mass tort law relief to find the relevant theoretical basis, and according tosome real solutions, implementation of the victim’s relief.Introduced. The paper is divided into four parts of mass tort law relief system. The firstpart is the large-scale infringement and legal relief general introduction. This article studiesand explores the definition of the concept of mass torts, characteristics, status, causes andmass tort law relief and its particularity, the particularity of mass tort clear difference with thegeneral tort and infringement relief.The second part is the comparative study of mass tort relief system. This paper mainlyintroduced by the United States of America, Germany and Japan on the relief of mass tort lawin related fields and relief system in practice. The United States and Japan to mass tort reliefsystem in the substantive law, procedural law and the social relief system are reflected, relatedsystem in Germany is mainly embodied in the procedural law and the social relief.The third part is the present situation of China’s massive relief of tort law and problemdescription. The relief of mass torts legislation and current practice of our country large-scaletort remedies are discussed in the paper, find out the problems in the system of China’s currentmass tort relief.The fourth part is to perfect the relief system of our country mass tort law. The main partof the relief system put forward suggestions on China’s tort liability system, litigation systemand socialization, to perfect our country mass tort law relief system, the timely and adequaterelief of mass tort victims, to realize the social healthy and orderly development.
