The Advent Of Individualized Society And Changes Of The Lawyers Working Relationship Research

China is in a period of social transformation from the whole society to theindividual society, with the increasingly divided society, the totality of the socialmechanisms exposed more and more abuse, social differentiation and flow as well asand the pursuit of individual freedoms and rights urge the relationship between stateand society has been a fundamental change. With the advent of the individualizedsociety, the individual was spun off from state or collective organization, gainedfreedom of identity, as well as more autonomy. Individual’s self-awareness isprominent, and person’s life trajectory is a self-writing process, the individualresponsible for their own behavior. Standardized life has collapsed. Time to make achoice, the individual often will exceed the normative way and thus a new form ofrelationship. Modern society, individuals tend to work as a means to establish contactwith the community. In terms of working relationship, this new relationship is mainlyreflected in two aspects: the relationship of the individual and unit organization; therelationship between the individual and the individual.Qualitative research as the main research method, and in the data collectionprocess I mainly uses two methods of field research and literature, to observe as theprimary way, also the interviews and literatures. As a pretender, I entered ZY LLP toconduct research observation. I focus on effects of the changes of the relationshipbetween the individual lawyers and law firms and individual lawyers and individuallawyers. The analysis revealed that the relationship between law firms and lawyershas changed from identity control into a contractual labor relations, the units weakenthe control of the individual, the dependence of the individual to the organizationweakened, autonomy enhanced; With the lawyers’ professional development trend,lawyers working with more possibilities, economic rather than political forces play anincreasingly important role in the work of lawyers, and lawyer mobility has enhanced;Bureaucracy is replaced by the economic strata of the market economy gradually,individual concerns of life from the political level to the economic aspects of life, thelaw firm structure by the bureaucratic hierarchy to a flat, the individual is responsiblefor their own sake; Social division of labor makes the stronger dependence betweenindividuals，this makes more harmonious relationship between the lawyer and greaterequality between the parties.This relationship changes reflect the requirements of individual autonomy, in theperiod of social transition. However, freedom is the result of a system driven, individual freed from the traditional working relationship into the bondage of themarket once again. The individuals always faced with the pressure applied by thesystem structure. The traditional form of relationship between the individual andsocial was to subvert, the work became part of the bridge. Thus independent life atany time may be in a state of self-defects, because of changes in the work. There isno unified standard; the individual must be more efforts in order to get a position inthe society. Therefore, a public life is necessary. Durkheim is optimistic for the socialintegration, the lawyers also practice caters to the idea of Durkheim: Professionalgroups to achieve social connection.
