With the rapid development of economy in our country, social transformationand the accelerating rhythm of life, as well as the social competition pressureincreasing, people are under a lot of work pressure and psychological pressure, causemental disease prevalence rate increased year by year, causing a serious threat to thepublic mental health. With all kinds of violations of social continuously exposure, thelife and health right and the freedom of life of patients with mental disorders isdifficult to ensure, more and more people begin to concern in patients with mentaldisorder problems of the protection of rights. But the problems of protection of therights and interests of mental health workers are being ignored, medical personnelunder great pressure. China’s "mental health law" has been promulgated in May1,2013. Although it took so long time to soliciting opinions and change before the lawpromulgated, there are still exist some shortcomings, some terms lack specificelaboration and implementation of the program, many problems may appear inpractice. Therefore, it has important significance of legal issues related to mentalhealth and analysis on the protection of the interests of both patients and medical staff.The purpose is to learn about the status quo of patients with mental disorders andhealth care workers rights protection and legal issues, a comprehensive analysis ofinadequate protection of the rights and interests of patients and medical staff. Thearticle also aims at providing advice to improve the mental hearth law and promotethe development of mental hearth career.There are two kinds of the data collection method:(1) Through hospital recordsobtained in patients with psychiatric hospital1089mental disorders of sex, age,occupation,, marriage, education, cause of disease, the guardian, diagnosis results areinvestigated.(2) By convenient sampling and cluster sampling method, selected the7psychiatric hospital psychiatric staff as an object of investigation. By using aself-designed questionnaire, the investigator site under the guidance of aself-administered questionnaire, The mental Non-welfare in5hospitals, welfare in2 hospitals,500questionnaires,482valid questionnaires were recovered,96.4%efficiency. The questionnaire content mainly includes professional background, rightsprotection, environment, occupation satisfaction and mental health law issues.The inquiry found that mental disease is a chronic disease in patients withlong-term treatment, the right of life of Patients included inadequate homeless is lackto protection, Income levels in patients with low, treatment cost burden, but with theright of personal freedom to maintain relatively well. The guardian named with theparents and spouses, and the guardian have sent right of administration. The right ofhuman dignity and personal safety of Health care workers have been damaged, lowlevel of specialization of occupation, belongingness difference, the sense of belongingof occupation difference, the difference of treatment satisfaction, and occupationprotection measures on hospital construction was not satisfied, the rights and interestsof Health care workers have been damaged. There were some suggestions accordingto the conclusion: First of all, the terms of the concrete elaboration law, speed up thelegislation of mental health. Such as ensuring patients rights and interests of targeted,the establishment of medical staff rights protection channel, improve the stafftreatment, establish guardian send access standards, promote the standardization ofjudicial authentication, collaborative reduce cost burden. Second, improve the mentalhealth service system. Such as the establishment of community mental health servicesystem, to cultivate professional medical team, improve the degree of public mentalhealth knowledge level, etc.
