Legal Problem Research On Lost Property

With the complexity and refinement of the social and practical problemsincreasing, the reality of the economic interests and moral values come into a collision,the improvement of the law and the security of society become an increasinglyimportant role. Therefore, the legal system should be more detailed and richer in orderto guarantee the settlement of social disputes and to maintain interpersonal contacts.We are familiar with Lost Property system in our lives; almost everyone has theexperience of picking up others’ lost property. The Perfection of Lost Property systemis the essential to our lives.This thesis is by using the comparative analysis of law, literature interpretationand case analysis, by referring to a number of legal scholars research and a largenumber of real legal cases. Some of the articles are from foreign scholars; some ofthem are from excellent students’ thesis. More than these, there are both real legalcases and elaboration of existing laws. I will do my best to present this paper to you.Through the study of legal issues of the Lost Property I understand the legalknowledge about the Lost Property and its academic background. I am able to see thecurrent situation of our country regard the Lost Property and know the history of thedevelopment of the Lost Property. At the same time, I get the knowledge from boththe horizontal and vertical perspectives. Lost Property laws already leap in thedevelopment, especially after the "Property Law" has been introduced. It is notdifficult to see from the enactment of the ordinance Property Law that our countryhopes to have a positive attitude and a strong willingness to improve China’s legalsystem which is detailed, specific, targeted and operating. This thesis is through withthe existing platforms to illustrate the concept of the Lost Property from multipleaspects. Furthermore, I make a comparison, from a national perspective, betweenChinese and foreign legal system, to find some imperfections of the Lost PropertySystem which should be improved. Finally, I propose5viewpoints according to myfindings of the Lost Property, and do my best to complete the research of the legal issues in Lost Property.Lost Property law is worth knowing and doing depth research. I hope this thesiswill be able to articulate my own views clearly and become a reference for others.
