The Legal Countermeasures Study Of Domestic Violence

Domestic violence has become a global social problem. Whether it can properly solve, relates to the guarantee of human rights, family harmony, social harmony, and the stability of the country. Before this, there are a lot of anti-family violence law experts and scholars put forward the corresponding opinions and suggestions, their research results laid a good theoretical basis of setting an anti-family violence law, provided the theoretical basis to force against domestic violence, and provided important reference for subsequent research. In reference to the predecessors’research results, I began to study domestic violence law countermeasures. The article is divided into five parts:The first part is introduction, the introduction part firstly discussed the reasons of my choice and significance of the topic, I want to tell the readers my writing purpose, and I hope I can get everybody’s chord. Secondly I try to analyze the current research status of this subject. That is the existing research results of domestic violence countermeasures. The third part mainly discussed the research content and the research methods of domestic violence. The article summarized the international documents and conventions on the definition of domestic violence, discussed some understanding of the world in the existing laws and regulations, and led to our country "the supreme people’s court about applicable<marriage law of the People’s Republic of China>(1) the explanation of some issues," article1of the interpretation of the concept of domestic violence.. Designed to allow readers to fully understand the concept of domestic violence in different stage, different countries have different definition. If you want to get an accurately, reasonable definition of domestic violence, you must based on the original concept, and determined based on national conditions, combined theory and practice. And we can grasp the nature of domestic violence through the characteristics of domestic violence. So the article summarized the characteristics of the domestic violence from six aspects. The third part analyzed the reasons of the existence of domestic violence in our country, and it is conducive to deal with domestic violence from the root. The fourth part discussed the regulations of our country current law on domestic violence; it summarized the current outstanding achievements in the department laws to domestic violence problem, and at the same time, found the disadvantages about them. The fifth part from four aspects, such as:set up dedicated anti-domestic violence law, clear the administrative responsibility of domestic violence, strengthening the judicial intervention of domestic violence problem, improve domestic violence relief system, to put forward the legal countermeasures to prevent and punish the domestic violence in our country. Domestic violence law countermeasures research is a long-term and arduous task, it requires each social people have a strong sense of social responsibility, and make its own contribution to develop and enrich the anti-family violence law.
