Research On The News Report And The Prevention Of Criminal Imitations

In recent years, series of violent cases arouse the author’s attention and thinking. Similar cases which occurred constantly expand their negative social consequences. What are hidden behind the series of violent cases are the delation full of victims’ families’ insufferable agonies afflicted by the criminal suspects and the public’s query to the stability of the society. It also implies the glaring lack of the criminal imitations research in legal profession. In order to prevent more tragedies, jurists need to pay more attention to the study of the criminal imitation and seek measures to solve the problem.Criminal imitations is the imitation of the same or similar implemented criminal behavior which carries heavy negative social consequences and features in selectiveness of subject and infectiousness of the criminal process. These features give an immediate and justified rise to the necessity and possibility of preventing criminal imitation. Criminal imitations spreads in two ways:stimulating criminal desire and learning criminal means.Information transmission is the bridge between criminal imitation model and potential criminal. News reports have the characteristics of high plasticity and low cost, which is the link that can give full play to the subjective initiative. Theory and practice has proved that the news report can awe criminal suspect, guard against illegal violation and propagandize the law. But on the other hand, the anomie of reports, such as the high frequency of crime report, the exaggerated plot and the biased point of view, may induce crime imitation behavior.Through empirical analysis, this paper summarizes the anomie of news reports in quantity, type, view and details. These errors of reports are likely to stimulate the criminal desire and enlighten the criminal means, thus inducing criminal imitations.After finding the essence through the phenomena, the main reasons of news report inducing crime imitating are the limitations of the media’s communication, the improper role of media and the lack of journalists’ legal consciousness. In order to avoid the anomie of report effectively and seek feasible prevention countermeasures, the media must suit the remedy to the case. In the reports of violent cases, the media should firstly consider the relationship between social benefit and economic benefit, then bear a high consciousness of social responsibility; secondly, we should stick to the principle of rationally moderate report and regulate the amount of news reports, processing on the ratio of various divided genres and detail management; thirdly, state organs and the audiences should strengthen the efforts of supervision and inspection on the media and guide the activities of transmission positively. Finally, media’s literacy training is also indispensable in the situation of cleaning the environment. People in all walks of life should take various measures to improve the media literacy in legality so as to suppress criminal desire of potential criminal and eliminate the phenomenon of criminal imitations.Although the complete uprooting of criminal imitations will not be achieved in the short term through the regulation of media, with the development of the theoretical research on the prevention of criminal imitations, the news report must be able to play a greater role in the prevention of criminal imitations problems.
