Nowadays China, the people’s police carry high expectations of the whole society. Our country’s police sacrifice a lot for the public interest. Prison police is an important part of the People’s police, who execute sentences and carry out the punishment and reform of criminals, bearing the arduous task to prevent and decrease crime. For a long time, Prison police work in remote areas away from the city because of industry’s particularity and historical reasons. Their work is unknown, guarding the"volcanic venl" and "explosive magazine" and fulfilling mission with youth, health,blood and even life. They made a significant contribution to the protection of fundamental interests of the masses of the people and maintain social harmony and stability.In recent years, China has made great progress in the protection of criminals’rights and interests. But regarding the protection of prison police’s rights and interests, the study and research is still backward. Nowadays there is a lot of obliged and prohibited request in the legislative and institutional aspect but not enough rights and protection regulations. When the prison police perform his duties according to law, their law enforcement should be protected by law. The legitimate rights and interests of individuals can not be violated. In reality, because of imperfection in legislation, rights protection mechanism and remedy of the rights protection, prison police’s personal interests often been infringed. Because of the rapid change of constituent of criminal, backward legal environment and law enforcement philosophy, blank power regulation system and criminals’excessive safeguarding rights, the law enforcement powers of prison police can not get effective protection, which affect the enforcement of the Criminal Law seriously and weaken the severity and authority of execution of punishment of prison.This article introduces the current situation that the prison police’s individual rights such as life and health rights and rest rights and enforcement powers is getting into trouble, on the basis of analyzing the content of prison police’s personal rights and enforcement powers with the method of combing theory with practice. This article also analyses and discusses the reasons of ineffective protection, drawing on useful experience in the related academic researcli achievement and judicial practice to put forward that combines the protection of prison police’s personal rights with enforcement powers, works along both lines, helps mutual promotion and brings out the best in each other. They should be completed form the aspects of protection legislation, establishment of social support system, speeding up the construction of law enforcement information and deepening the reform of prison system to achieve best comprehensive protection efficiency and protect the personal rights and interests of prison police effectively.
