Research On Protection Of Rights And Interests Of Prison Police

The amendments to the Criminal Procedure Law of 2012 were promulgated and implemented,and human rights protection was included in the series of fundamental tasks adjusted by the law.This is one of the great advances recognized by the academic community and reflects human rights from another perspective.Guarantee has received more and more attention in our country.Through the study of the amendment and related human rights protection theory,it can be found that the focus of human rights protection clearly favors the rights of police law enforcement targets,while criminal law enforcement enforcers or law enforcers are regarded as objects that need to be constrained.Inadvertently became the opposite of human rights protection.The regulation and supervision of law enforcement rights have received unprecedented attention,while the protection and attention of law enforcement rights is obviously insufficient.Looking at the entire prison system,the situation is even less optimistic.In recent years,the focus of attention from all walks of life has always focused on the rights of criminals.The relative rights of prison police are rarely mentioned.The rights of criminals have been better and better protected.On the contrary,the legitimate rights of prison police have been challenged unprecedentedly.The violation of rights and interests has become more serious.In the past few years,with the changes in the composition of prisoners,the demands of criminals have become complex and changeable.The non-violence and violent assaults in prisons have been frequent,and the exploration of the rights and protection of prison police has a long way to go.The body of this article is divided into five parts:The first part:the theoretical analysis of the protection of prison police rights.The clarification of prison police rights is a guarantee of multiple rights based on police duties.It analyzes the relationship between prison police rights and police power,citizen rights and the four characteristics of prison police rights,and uses this as a direction to emphasize the need to protect the rights and interests of prison police.The second part:the investigation of the status quo of prison police rights protection in China.First of all,it introduces the legislative status and actual operation of the protection of prison police rights in China.Secondly,it analyzes the severe situation and existing problems faced by prison police rights protection.The third part:the analysis of the reasons for the lack of protection of prison police rights in China.Starting from the four aspects of the legal system,prisons,prisoners and the society,this paper analyzes the historical reasons and changes in the situation that have caused the lack of protection of prison police rights in China.The fourth part:the reference of the protection of foreign prison police rights and interests.Through comparison with the current practice of protecting the rights and interests of prisons in foreign countries,three foreign experiences worth learning are summarized.The fifth part:the specific countermeasures for the protection of prison police rights in China.Based on the research on the actual situation and the causes,the paper draws on the reasonable practices and systems from abroad,and proposes countermeasures from five aspects:protection system,rights protection,police security,police quality and law enforcement environment.
