Study On Law Issues With Regard To Real Estate Compallies’ Illegal Construction

With the accelerated pace of urbanization during the period from2001to2012, real estate realized a rapid development across the nation, somehow, some Real Estate companies went beyond their occupation moral bottom line in order to pursue the maximization of benefits, they rushed into danger to build the illegal construction. It is an open secret in the eyes of real estate developers that the illegal construction is their underlying rules to escape from paying the taxes and the one to shorten construction period. Many of the real estate developers had acts of illegal construction. Real estate developers’ acts of illegal construction not only violated the dignity of the law, but also disrupted the market order. To even worse, they are seriously effect long-term planning of the country and public interest. The Illegal construction conduct by real estate developers has become a social problem of emergency and has aroused widespread concern in society. In order to maintain social stability and promote social harmony, real estate development and management should be regulated from the aspect of law and from the source so as to eliminate repeat illegal construction behavior.The thesis is forwarded to analyze prevail laws in relation with illegal construction with a practical case of illegal construction acted by Beijing Dongxinglian Real Estate Corporation as the main plus other illegal construction cases acted by other corporations. The analysis stands on three aspects:legislation, enforcement and supervision. Weaknesses are diagnosed and advices for improvement are put forward. The thesis is composed of three chapters. Chapter1:it cites an example of case of illegal construction and demolition conduct by Beijing Dongxinglian Real Estate Corporation and analyze it in the way of law. Chapter2:it analyzed behind-time enhancement of law with the case in Chapter1and other similar cases and pointed out the parts that required to be improved in aspects of legislation, enforcement and supervision. Chapter3:In view of foresaid cited cases and current situation in China, it put forwarded some advices for perfection of law and building of rules.
