With the rapid modernization of industry, domestic service industry such as bamboo shoots after a spring rain as "after another". More and more families choose professional housekeeping service personnel to do housework, social members pay more attention to their work, the dedication to work is not only synonymous with men, women gradually pay attention to their development of social work. All these not only give birth to the socialization of housework, but also stimulate the interest about the value of housework, housework’s compensation has been widely recognized. Foreign legislation on protection of housework is earlier and more perfect. Article fortieth of current "marriage law" in China affirms the value of housework clearly, makes up defects of legislation, this is worth for sure. But the law of compensation system for the value of housework is limited, there are still many needs to be improved from the legislative and judicial. In order to improve the applicable rate of this law in real life, truly realize the purpose of protecting the housework, author writes this paper and puts forward related suggestions about the article fortieth of "marriage law".This paper is divided into four parts:overview about the compensation of value of housework, foreign legislation about the protection of the value of housework and the analysis of the present situation, present situation and analysis about compensation system of the value of housework in China, legislative suggestions on perfecting housework’s value in China. The first part mainly introduces the housework’s basic definition and characteristics, introduce the economic and legal bases of housework’s value, explains the social significance about protection. The second part mainly introduces the relevant legislation about the protection of housework’s value of Germany, the United States and France, analyses the advantages and disadvantages between them. The third part mainly aims at China’s current "marriage law" in article fortieth, analyses comprehensively the provisions on protection of the value of housework, respectively explains the relevant provisions of our country in the view of legislative and judicial, puts forward the disadvantages and improvement about them. In the fourth part, on the basis of the disadvantages put forward in the third part and the foreign legislative advantages in the second part, the author introduces the relevant suggestions to improve China’s current "marriage law" in article fortieth. The right of housework’s compensation through the improvement of legislation, standardizing the judicial gradually, can be widely used. Take this, the right of housework’s party also can get a comprehensive protection.
