Study On The Marriage Law Of China Protection To The Value Of Women’s Housework

Housework as a presence on the marriage within the family private labor, oftenclosely related with women. Because of Chinas traditional”Man advocate outside,woman inside" pattern of the family usually determines the wife bears more raisingchildren, caring for the elderly, helping her husband, so the value of housework inthe legislation on the confirmation of the couples right equality has a very importantsignificance.Chinas2001revised " marriage law " affirm the value of housework, andthe addition of the marital agreement property system under the houseworkcompensation. But in practice there are still many limitations, in legislation,compensation calculation, proof, application of law on such issues to be furtherperfect. In order to avoid the problems that the maneuverability is not high, thebeneficiary is not much, and reflect the legal fair. In order to protect the right ofequality justice for the concept of husband and wife, the author use the literature ofthe two analysis and comparison research method to confirm and protect womenhousework labor value. This research reviews the marriage law to protect womensdomestic labor value in the field of research results. Through defining the women’shousework and the value, analyses the legislative theory, the study compared severaltypical foreign legislative model for reference. Based on in-depth analysis of Chinasmarriage law protection of womens domestic labor value, discussed the legislation,compensation, law expression is insufficient, put forward correspondingcountermeasure to suggest.
