Science and technology is a double-edged sword, although it make people convenient way of communication, while at the same time, it brings us troubles, personal information disclosure is one of them. Demand in the spiritual is greater than the material needs of today, to strengthen the right of personal information protection, to give the main body of the information security, to safeguard the lawful rights and interests of the main body of the information, which is particularly important.This article show some opinions related to present situation of personal information rights in china, describing in four aspects.The first part, considering the concept of law, this paper analyzes the definition of the right of personal information, subject and object. Personal information is not merely personal privacy, personal personality or personal data, but also including name, gender, height, weight, telephone, id card number, home address, religious belief and personal life data set, the data set can separate the information subject from the other.The second part, introducing international personal information rights protection legislation and corresponding analysis of inadequate legislation, to provide some indication of perfecting our personal information rights. The third part, analyzing the personal information rights protection in China at present situation. People are lack of personal information rights protection consciousness, the country did not make the perfect protection of personal information rights law, government agencies and private enterprises in the personal information communication have absolute advantages, etc., all these lead to personal information is opened in public and abused unreasonable.The fourth part is thinking about perfecting personal information protection of rights. This part goes on from two aspects, firstly, elaborated on the necessity of the personal information rights protection, secondly, researching on how to protect personal information rights, including legislation idea, conflict coordination, tort relief etc.
