Study On Emission Trading System

Nowadays, more and more environmental issues are happening all around the world. Under the circumstance, people pay more and more attention on environment protecting. Researchers from many countries work hard to find a new pollution control system to control the pollution and protect the environment.Since1980s, emission trading, which has some features of market mechanism, is attracting researchers of the entire world.With the development of our economy, the environmental problems happen more frequently. In my opinion, the use of the emission trading system will be an important measure to change our environment circumstance.As a focus in the field of environment law, the research of emission trading has obtained many achievements, but there are also many inadequacies. The emission trading system originated in the United States, China has already introduced and set up many pilots in many cities. However, we cannot ignore that china has more complex conditions in economic, environment and social development. As a result, we may face more problems in establishing and promoting the use of the emission trading system.We should make the basic theory of emission trading system more specific, such as the concept of the emission right, the legal nature of the emission right, the initial allocation of the emission right, and the establishment of the emission trading market and so on. Therefore, strengthen the research of these questions of emission trading system, is the basis of its using all over our country. At the same time, emission trading system will be an important safeguard if we participate the emission reduction of the international community in the future.At present, emission trading system are not been legislated neither in environment law system or the other law systems. We recommend that emission trading system should be legislated in our environment law as earlier as impossible in china. With the help of emission trading, our environment circumstance must be improved to a high level which is more comfortable to live. Our environmental management system will be more perfect.
