The Study Of The Administrative Legislation Hearing

The administrative legislations have been usual administrative activities, and become one of the sources of the legality of specific administrative act together with the law. What is the legitimacy of the administrative legislations has apparently become an important issue. The interpretation of the legitimacy of the administrative legislations also has multiple modes. This thesis describes the mode and method of transmission belt and explains the sociological point of the social division of labor theory mode, and finally from the administrative law principles of due process point of view to explain the legitimacy of the administrative legislation and it’s controlled.The democratic participation in the administrative legislation process can protect the civil rights, and control the executive’s imperious. There are varieties of specific measures of the system of democratic participation. They are traditional ways or modern ways using communication and Internet Technology. The traditional ways include:forums, seminars, circulation of regulatory proposals comment, Public notice-and-comment, hearings. Hearing is the core of these methods, because it has characteristics of openness, comprehensibility, consultation and is trial-type.This paper analyzes the U.S. federal procedural law hearing system and put forward the specific proposals about the administrative legislation hearing system in China.
