Defective Vehicle recall system is inevitable product when the social developed to acertain degree.Chinese recall legal system start from publishing of ‘Recall AdministrativeRegulation of Defected Cars’ in2004.8yeas’ development has achieved a lot, meanwhileexposed some shortage. Along with the awareness of consumers’ right-protection, thecomplete cars recall system is widely expected. In this situation,the State Councilpromulgated the ‘Recall Administrative Ordinance of Defeceive Automobiles’ in October2012,this means Chinese defective automobiles recall legislation system is going a setpeven futher.There are four main chapters of this thesis,it’s based on the ‘regulation’, mainlyfocused on the research of Defective automobiles recall legislation system in China.Thefirst chapter mainly discusses the meaning of “defective” and “recall system”.In the secondand the third part,by comparing the auto recall system with the United States andJapan,point out that there still had a number of questions in China’s recall legalsystem,such as the legal system and the government management system is not perfect,environmental standards are not included in the accounted range of recall and there is shortof professional third-party testing organizations etc.Aiming at these problems,the authorfocus on the solving measures in the last part of this thesis.The measures include thatformulate the basic law and supporting regulations to improve our legal system,establish aspecialized agencies who responsible for automobile recall,while,there also include thatsigned the requirements of environmental protection into law etc. seek to reasonablesuggestions and recommendations in order to positively impact on Chinese defectiveautomobiles recall legislation system.
