The Analysis On The Criminal Reconciliation Of Traffic Accident Crime

Criminal reconciliation as a new way to resolve criminal matters,legal circles and has been widely recognized by practitioners.In the process of criminal lawsuit of our country,applying to the criminal reconciliation system conforms to the basic idea of building a socialist harmonious society.In recent years,with the increasing of traffic accident cases which belong to the negligent crimes of social harmlessness,applying the criminal reconciliation to solve these cases in judicial practice embodies the principle of tempering justice with mercy in the judicial system in China.This system can not only attact the crimes accurently,but also rectify, alterate, repair the damaged social relations.At the meanwhile,it can offset the interest of the party which has been damaged by crimination.And then, dissolving the contradiction between victims and perpetrators to make them coexistence in harmonious.This article mainly divides into three parts.The first part, the basic theory of criminal reconciliation system and the status of the development. This part is mainly about the concept, the connotation and the development status of criminal reconciliation.The second part, analysis of traffic accident cases apply to the criminal reconciliation system. Through the comparative analysis of the two traffic accident cases, to put forward the necessity of traffic accident case applying to criminal reconciliation system, the applicable conditions and the principles to follow.The third part, the deficiencies and perfections of applying to the criminal reconciliation in traffic accident cases. Whether in legislation or judicial practice, there are some disadvantages of applying to the criminal reconciliation in traffic accident cases,and then put forward the corresponding improvement measures to these disadvantages.
