According to the theory of Marx’s state and social relations, the state is a kind of special and coercive power divided from the social organization. The tension of state and society is the result of the country for the public interest by a public organization and alienation as a special class of special groups,this is to say, state was established to coordinate the interests and social contradiction, but a special class of special interest makes countries lose universality and particularity. Along with the development and progress of the political, economic, cultural and social undertakings, especially along with the increasing ability of the autonomy of society itself, the country will give power restored to society, countries must eventually return to society.Civil right is an essential part of personal rights as a citizen, is the foundation of political power and source of legitimacy. Countries always represents public power, the society is the guarantee of civil rights and power. In stressed country as the necessary "evil" under the premise of power, along with mature and perfect of the social autonomy ability, the rights of citizens, in fact, are a kind of common pursuit and goal of the country and the society.China is a bureaucracy highly developed country, strong state and weak society has been Chinese basic national condition and the system characteristic. Due to the authority of the traditional concept in our country, weak civil rights consciousness, unsound civil rights protection mechanism, and after the founding of the formation of the "strong state and weak society", the concept of civil rights has been neglected in the long term, enjoyed legal rights can not get the respect state and society deserve, the law rules and rights can not get proper implementation in the political and social practice, and get protection of power difficultly. Since China’s reform and opening up, along with China’s social and economic decentralization, the expansion of political democratization, the relationship between "strong state and weak society" has a big change. During transformation of state and society relations, the citizen’s political, economic, cultural and social rights have great progress and development, but with China’s political, economic, cultural and social development requirements, there is still a gap, citizen’s political, economic, cultural and social rights, on the whole, still lags behind. Citizen political, economic, cultural and social rights weakening and the lack of some aspects and disrespectful unaccomplished and unprotective constitutional legal rights, direct result is that citizens’political rights insufficient endogenous power corruption, economic rights frustrated cause polarization distribution of resources, lack of the rights of civil society derives mass conflicts cluster, etc.Crisis of political legitimacy,which derives the loss of civil rights from tensions of state and society relations, is the core issue of sustainable development and stability in our country. Our state should begin from the "strong state-strong society" two angle to set up a service-oriented countries concept, strengthen the consciousness of citizens’rights and improve the citizen rights protection mechanism to safeguard our state’s civil rights, to strengthen the state’s political legitimacy foundation, to establish new state and social relations on the basis of benign interaction of the political state and civil society, to truly achieve constitutionalism system, to make political legitimacy gain social basis and play actual function fully.
