In recent years, China has gradually entered the era of rapid development of the real estate business. Increasingly high prices, so that ordinary citizens to buy real estate to become a heavy burden. In this case, small property came into being. However, the presence of small property has been controversial from the national policy, small property room because there is no real property and sentenced for the offense, but the small property and development also has its rationality, is in line with the socialist market economy, trends, therefore, small property has important research value.but with social development, this land system and the existing land laws leads to contradictions, the uncompleted-right house is the product of this contradiction. China’s current legal definition of the uncompleted-right house to be illegal, contrary to the principle of equality in civil law, property law in the voluntary principles and best use of the principles of the market economy does not conform to the law of development. Therefore, the uncompleted-right house should be given legal status, and properly resolve social contradictions, to fill loopholes in the law. Meanwhile, China should be based on the legalization of the uncompleted-right house as an opportunity to appropriate principles, deepening the agrarian reform, and constantly improve the system of collective land ownership, and ultimately solve the problem of the uncompleted-right house.
