In this paper, the statement of the thinking and the suggestion which are about the legislation of fair preschool education, is the result of the research which through the combining of the analyzing of the problem that exists in our country’s fair preschool education and our present laws and regulations about the preschool education, plus the learning of overseas advanced legislation and the advanced experience. Taking the educational right of the citizen and the equality of the educational chance as reference, the research of this paper which adopt the method of literature review, is on the basis of previous studies. The legislation of fair preschool education is the system safeguard of the preschool education enterprise. The fairness of education is the problem of the developing process of our country’s preschool education enterprise which we must confront. To handle it correctly or not, does not just only concern the developing of the preschool education, but interfere the structure and the perfection of the entire education enterprise of the nation. Nowadays, the problem of fairness about our country’s preschool education is prominent. The fairness of the legislation of preschool education is cryingneed. And it plays a vital role in the definition of the principle of preschool education and the perfection of the rationality and legality of the legislation of preschool educational.This study is divided into:Introduction section:Proposing the questions to be studied of, the goal and significance, furthermore, the mentality and method of this article.The first chapter:The value orientation of preschool education legislation is fair, and the universal of education is the ultimate goal of the legislation. There is a rich theoretical basis of the equity legislation of preschool education. There is also certain legal basis and institutional guarantee in our country.The second chapter:Chinese preschool status register as the gap between urban and rural areas, the gap between rich and poor areas, the lack of public capital investment and not balance of preschool education, the inadequate of laws and policies. The preschool education legislation has a large lack of high-level standard. The relevant law lags behind the times. The adverse implementation led to the poor social effects, so that the spirit of equity education did not reflect.The third chapter:The overview of equity legislation of preschool education of major countries of foreign, and take lessons of the advantages of legislative experience and advanced systems from abroad.The fourth chapter:Based on the study before, I will try to put forward the suggestion of improving equity legislation of preschool education. We should establish the guiding ideology of "public welfare" and "universal". The idea of balanced and complementary education should be cleared. The law should emphasis on the protection of the interests of vulnerable children. And the government should take more responsibility to protect educational equity.
