In different stages of social development, social contradictions will present differentcharacteristics. In the seventys of the20th century in Japan, karoshi phenomenon firstappeared in the field of labor relations. Now, also in the period of social transformation ofChina, karoshi incident also occurred frequently,but due to the problems on the level oflegal culture, legal rules, karoshi has not yet been approved related labor legislation in ourcountry. The existing legal system cannot be resolved karoshi the contradiction in laborand management.To this, the author through analysis karoshi of events occurring in ourcountry, combing across death labor legislation in our country, the theory of knowledgeand of dealing with the current situation and existing problems,at the same time based onkaroshi the lack of legal regulation and to Japan, the United States, and our country Taiwanarea processing karoshi experience summary, put forward our country regulation of karoshiresponse strategies.This article is divided into basic content: introduction part mainly introduced thestatus of karoshi hence research topic in this paper;the first part analyses the basic theoryof karoshi problems, through the analysis about karoshi definition and nature of the varioustheories viewpoint in this paper; the second part analyzes the karoshi legislative situationand existing problems of legal regulation; third part combed through Japan, the UnitedStates and our country Taiwan area processing karoshi measures and experience for ourcountry from the aspect of legal regulation karoshi; the fourth part, aiming at the problemsin our country, by using the experience of other countries and regions of the reasonablepart of the construction of karoshi relief and prevention legal system,hope to resolvekaroshi caused by labor disputes, and promote the harmonious development of laborrelations.
