The industrial injury is a new word format after the industrial revelution,which is an additional product of industrial production.Industrial accidents from its birth has become one of the problem of the human society which has caused the physical and psychiatric harm to the labours, influence the smooth progress of enterprise production acting,as well as the profound development of national economy. In order to solve the problem of industrial injury,work-related injury insurance system came into being.Industrial injury insurance is a part of the social security system at present,most counters in the world have established the legal system of industrial injury insurance.The legal system of industrial injury insurance can not only protect the legitimate rights properly and the interests of workers, but also play a significant role in maintaining a stable social order.Since 1950,China,has established the legal system of industrial injury insurance, after several revision the current implementation is the 2011 revision of the industrial injury insurance regulation.The implementation industrial injury insurance regulation indeed has solved part of our social dispute issue,but during these five years. We have also seen some flaws and defects which exist in the regulations such as the force failure in the industrial injury insurance.The coverage of insurance is law, the ascertainment of a work-related injury defects and so on.We should pay more attention to these problems and improve the legal system of industrial injury insurance in time in order to protect workers better resolve disputes and maintain social stability.This paper in the full study on the basis of China's industrial injury insurance regulation Comparing and researching the characteristic of Germany ,Japan and the American industrial injury insurance legal system of our country,it provided referential international experience and analysis the legislative present situation of China's industrial injury insurance,find the problem and put forward feasible suggestion and strive to achieve the effect of casting a brick to attract jade.
