Research On The Legal System Of Work Injury Recognition

A modern and perfect social security system is a safety net for maintaining social stability and a booster for economic development.With the evolution of industrialization,modern society has also entered a risk society.The work-related injury insurance system is an important organic part of the national social insurance system.Since its establishment in the 1950 s,the work-related injury insurance system in my country has It has played an important role in dispersing enterprise risks,alleviating social conflicts,and promoting social equity and economic development.However,due to the lagging nature of the law,disputes over work-related injuries occur frequently,and in reality,it is not conducive to the realization of the rights and interests of employees with work-related injuries and the maintenance of their rights.The long-term malpractice has seriously hindered the implementation of the work-related injury insurance law and the realization of its legislative purpose.Therefore,this paper has certain theoretical value and practical significance through the research on the identification system of work-related injury.The first part sorts out the basic theory of work-related injury identification,first discusses related concepts,including what is work-related injury and work-related injury identification,and analyzes the characteristics and functions of work-related injury identification.Secondly,taking labor relationship as the breakthrough point,it discusses the connotation and identification standard of labor relationship as the precondition for the identification of work-related injury.The theoretical basis for the following questions and research will be prepared.The second part analyzes the problems existing in our country’s current work-related injury system from two dimensions.First,it discusses its legislative deficiencies,starting from the basic conditions for work-related injury identification,namely,the identification standard of labor relations.Secondly,starting from the work-related injury identification system,it expounds the existing problems in the identification of work-related injuries and the substantive standards and procedures.The third part analyzes the legal system of work-related injury recognition in non-territorial countries,and introduces the work-related injury recognition system in the United States,Germany and Japan.The stone of other mountains can be used to attack jade.By analyzing the advanced experience outside the region,it discusses the experience and enlightenment of the identification system for work-related injuries outside the region to my country from the aspects of identification standards and identification procedures.In the fourth part,aiming at the problems analyzed in the second part of the article,from the three perspectives of the work-related injury identification object,the work-related injury identification standard and the work-related injury identification procedure,it puts forward targeted suggestions for the improvement of the work-related injury identification system in my country.
