The Exploration Of Sunset Rules In The Application Of The Regulation In Our Country

At present, our country is in the key period of the economic transformation, and the industrial regulations pattern is not a static development process. The regulation not only fit to the circumstance of political and economic system, but also update continually with the industrial development and upgrade. Chinese industry regulation reform doesn’t mean to cancel or reset regulation measures in the general sense, but try to find a more effective and appreciable regulation mechanism, so improve the regulation efficiency and management structure. A large number of scholars think that the Sunset rules will also have realistic meaning in the industrial regulation reform and development, besides the important role in the application of legislation field. In the regulation field, the decision and execution of the regulation contract is the important applicable field of Sunset rules. This paper focus on studying the economic rationality and necessity of Sunset rules applied to the regulation field, which aims to explore the Sunset rules’application in our industrial regulation in a deeper level. Sunset rules is a special legislative principles, which requires to set up the time limit in some laws. These laws must re-examine their effectiveness before the expiry date to decide their existence or not in the future. On one hand Sunset rules can deal with the relations of the laws’stability and flexibility; on the other hand urge the effective legal system to adapt to the rapid development of the economic society. Sunset rules embody a kind of dynamic mechanism of elimination in essence. From the end of1970s, the application range of Sunset rules expanded gradually from legislative field to political and economy areas. Especially in industry regulation field, with the development of the incentive regulation theory and practice, Sunset rules’economic rationality is also showed up in the application of industrial regulation.The main line of this paper is from the overview of Sunset rules, at first illustrates the background of development and application field of Sunset rules, and analyses the appliance in the industrial regulation. Then based on the complex principal-agent relations and information asymmetry problem in the regulation to explain the internal rationality of Sunset rules, and with the method of game theory to study the effectiveness of Sunset rules applied to the regulation policies. Meanwhile, in combination with the particularly concrete circumstance, such as the regulation environment, regulation quality, it demonstrates the feasibility of the Sunset rules used in our industrial regulation reform and development, and which is able to effectively relieve the contradiction between the government regulation structures and the enterprises, and promote the regulation efficiency. Through the foreign relevant examples to demonstrate the Sunset rules has the realistic basis and long-tern application value in the application of industrial regulation field in our country.
