The Study On Legal System Of Guangxi’s Agricultural Circular Economy

Agriculture is the foundation of the national economy and its sustainable development-an important part of our social and economic sustainable development-is the basic guarantee as well as the priori area to implement sustainable development strategy in China. As the western provinces of a big agricultural province, the proportion of the agricultural population in Guangxi is up to82.55%which is a larger share. With presenting of the great western development policy and establishment of C AFT A (China-ASEAN Free Trade Area) and the Northern BAY economic zone, Guangxi in the rapid development of economy had also faced serious ecological environment problems. Guangxi itself is moderate vulnerable ecological environment. In addition to a series of questions derived by the development of the economy seriously restricts the sustainable development. Soil pollution, soil erosion, desertification are more prominent problems, forest quality lower and lower, ecological function abate, biological diversity are threatened, industrial pollution, the countryside ecological environment pollution is serious, the drought, floods and other natural disasters frequently happened. All of these cause the arable land per capita of Guangxi under the national average and results in the intensifying conflict between human and land. In view of necessity and urgency for the development of agricultural circular economy in Guangxi, this article will show the comprehensive analysis about agricultural circulation economy legal mechanism in the parts of legislation, enforcement, law-abiding, which aims to perfect the agricultural circulation economy legal mechanism to make better agricultural circulation economy development; improve rural ecological environment and realize agricultural sustainable development and narrow the gap between Guangxi and the eastern region and accelerate the pace of construction of new countryside by changing the rural economic growth way; finally realize the sustainable development of economy and social progress in Guangxi.The article on the structure is divided into five parts:The first part is agricultural cycle economy summary which mainly analyses the meaning, structure and the theory basis of agricultural circulation economy, as well as the dialectic relation exists between agricultural circulation economy and agricultural circulation economic law, as well as, between agricultural circulation economy and law mechanism. Agricultural circular economy is the circular economy theory and ideology in the application of agriculture, it is a floorboard of reduce, reuse and recycling during the activities of agricultural production resources investment, production and consumption. Agricultural cycle economy is a subsystem of the circular economy system which is in essence a kind of ecological economy; it converted from depending on the agricultural resources consumption traditional linear growth of economic system to relying on ecological agriculture resources to development of circulation economy.The second part mainly analyzes the necessity and the feasibility of the circular economy law mechanism about agricultural development of Guangxi. The necessity of the circular economy law mechanism about agricultural development of Guangxi main contain:vulnerable ecological; natural disasters; the rural economic in poverty; lower content of agricultural science and technology; weak idea for the agricultural circulation economy; and the heavily destroyed countryside ecological environment. The feasibility of the circular economy law mechanism about agricultural development of Guangxi is mainly shows in the following respects:sufficient natural condition of Guangxi, the western development policy and the superiority of the national minority autonomous regions. Guangxi according to the constitution and the law not only can make local regulations, local government regulations and normative documents, can also according to the law on ethnic regional autonomy to enact autonomous decree and special decree, and it also have right to carry out the national law or stop the execution. To some extent, this gives the Guangxi local legislature great independence in the point of law. Through the analysis of necessity and feasibility about development of agricultural circulation economy law mechanism in Guangxi, it shows us the advantage and good momentum of rural agricultural economic development. The agricultural production ability is continuously improved; the rural economy is overwhelmingly blossomed. These laid a solid foundation for the development and perfection of agricultural circulation economy law mechanism. On the contrary, agricultural circulation economy law mechanism also provides powerful protection to the development of agricultural circulation economy in Guangxi.The third part analysis the current situation and shortcomings agricultural circulation economy legal mechanism of Guangxi, according to legal mechanism mainly including legislation, enforcement, legal consciousness the three parts, this paper will put points from these three contents as well. The first is legislation which includes national level of the legislation and local legislation of Guangxi. The insufficient agricultural circulation economy specialize in legislation absence, the legislative policies, too principle, lack of maneuverability, imperfection of rural agricultural ecological environment protection legislation. This paper also collects lots of material through the different channel. The Guangxi agricultural circulation economy over the relevant laws and regulations and some normative documents shows that regional national autonomy of Guangxi have not been taken full advantage, the countryside ecological environment problems have not been paid enough attention and meanwhile lack of incentive measures during the development of agricultural circular economy. The second content is about law enforcement, including:low consciousness on agricultural ecological environment protection, little practice and single means on the agricultural law enforcement, and financial support is not enough. The third content is on legal consciousness.The fourth part studies the case of agricultural circulation economy of Gong Cheng county of Guangxi, discusses how to develop agricultural circulation economy, and make benefits on the aspects of economic, ecological and social; precepts us the worthy experience, practice and related reference in the legal mechanism.The fifth part of the paper is to perfect Guangxi agricultural circulation economy legal mechanism, in allusion to the three aspects of the shortcomings of the reference during Guangxi agricultural circulation economy legislation, enforcement, law-abiding, benefit from the experience of Gong Cheng and aboard, and puts forward more perfect countermeasures. The researcher thinks that for legislation; it must carry through agriculture circulation economy, follow the scientific concept of the legislative principles, improve policy formatted with agricultural circulation economy aspects, make the circulating agricultural promotion law in time and fully exercise the corresponding legislation autonomy, strengthen the local legislation and highlight local feature in the legislation. For enforcement; it should enhance understanding of agricultural law enforcement department, improve a single administrative law enforcement means, and strengthen financial support. Regards to law-abiding; it could strengthen the propaganda guide, raise awareness of agriculture circulation economy and change the concept of development and to practice the idea of circular economy.
